Honestly not too worked up about this because it would be small money in my case, but I do very much dislike the government telling me how to use my own property in this way. Why exactly is it within anyone’s power to tell me how often I have to spend in my own home(s) if I’m not renting in any way?
Were condos at Sunday River ever intended to be housing for local folks full time? (Serious question). Seems like when you build properties like that on a resort it’s meant as a second home for the most part, that’s how I see it anyhow. So why should I be penalized for using it for its intended purpose?
I also still don’t see how anyone could really enforce this as written since it doesn’t actually require residency. How can they prove how many days you are or aren’t in your home?

Honestly not too worked up about this Nor should you be at this stage, IMO. There is still a long way to go before there is even anything to vote on, and it will face a lot of opposition on many fronts in the meantime. Good to be aware this is out there and keeping an eye on it, but not something to really be worried about now.

Burden of proof is always on the taxpayer. The only thing I’ve seen is that you would need to sign something attesting to spending at least x days in the home. Yep, but when push comes to shove under audit, you’ll need to prove your compliance. Florida is a no income tax state that attracts a lot of retirees in the winter that claim residency. I know quite a few of these folks and they keep pretty extensive files for the receipts...food, gas, ATM slips etc.

We built our place 19 years ago, had plans to rent. The moment the new furniture arrived, my wife looked at me and said, "we are never renting this place". We have never rented our place. I would never sleep in it again, I am with PM and Patroller wife. *Also, I spy Kmac place in the picture.

One of the condos we stayed in several years ago had a guest book. One of the previous entries contained, in rather graphic detail, the sexual (same sex and heterosexual) exploits of some recents guests and all the various pieces of furniture and kitchen utensils that were involved. It was so far out there that I assumed (hoped?) that is was a teenager trying to be funny/shocking. But in any case, yeah probably a good call on not renting your place if you also use it yourself.

I still remember buying our Studio at Brookside, we were obligated to rent it the first 2 weekends we owned it as there were bookings the mountain couldn't or wouldn't move. Still remember when we moved the old sleep/sofa out, at least 2 pairs of panties under it still. Never thought about renting a property out again (loaning it out to friends ok, never rent to unknown parties).
